Terms and Conditions for PLAI™ (Personalized Learning AI) Platform by 4Learn Education Technologies Ltd. 

These terms and conditions (“Agreement”) govern the use of the AI-powered learning management system SaaS platform, PLAI™, provided by 4Learn Education Technologies Ltd. (“4Learn”), a company based in Singapore. By accessing or using the PLAI™ platform, you agree to be bound by the terms and conditions outlined in this Agreement.

1. Access and Use of PLAI™ Platform

1.1 Registration: To access and use the PLAI™ platform, you must create an account and provide accurate and complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

1.2 Eligibility: You must be at least 18 years old or the legal age of majority in your jurisdiction to use the PLAI™ platform. By using the platform, you represent and warrant that you meet these eligibility requirements.

1.3 Usage Guidelines: You agree to use the PLAI™ platform in compliance with all applicable laws and regulations. You will not engage in any activity that may disrupt or interfere with the functioning of the platform or violate the rights of others.

2. Ownership and Intellectual Property

2.1 Platform Ownership: The PLAI™ platform, including all associated software, algorithms, and technologies, is owned by 4Learn and its licensors. 4Learn reserves all rights not explicitly granted to you in this Agreement.

2.2 Personal Data: By using the PLAI™ platform, you understand and agree that the use of your personal data is subject to 4Learn’s Privacy Policy.

2.3 Intellectual Property Rights: You acknowledge and agree that any feedback, suggestions, or ideas you provide to 4Learn regarding the PLAI™ platform may be used by 4Learn for any purpose without any obligation to compensate you.

3. Data Usage and Privacy

3.1 Data Collection: You agree that 4Learn may collect and process data from your use of the PLAI™ platform, including user analytics and performance indicators, for the purpose of improving and training AI and machine learning models.

3.2 Data Privacy: 4Learn will handle and process any personal data collected from you in accordance with applicable data protection laws and its Privacy Policy. 4Learn will take reasonable measures to ensure the security and confidentiality of your personal data.

3.3 Data Ownership: Any benefits derived from the AI models and machine learning algorithms developed based on the data collected from the PLAI™ platform solely belong to 4Learn. You do not have any claim to any benefits derived from the use of your data.

4. Pricing and Subscription

4.1 Pricing Details: Specifics on pricing, plans, and subscription details for the PLAI™ platform can be found on the website and in the terms of sale available at the time of purchase.

4.2 Payment: You agree to pay the applicable fees for the chosen subscription plan, as outlined in the terms of sale. All payments are non-refundable unless otherwise stated in the terms of sale or required by law.

4.3 Subscription Renewal: Your subscription will automatically renew for the chosen subscription period unless you cancel it prior to the renewal date. You are responsible for timely canceling your subscription if desired.

5. Termination and Suspension

5.1 Termination by User: You may terminate this Agreement by discontinuing the use of the PLAI™ platform and closing your account.

5.2 Termination by 4Learn: 4Learn may terminate this Agreement and your access to the PLAI™ platform at any time if you breach any provision of this Agreement or engage in any prohibited conduct.

5.3 Suspension of Access: 4Learn reserves the right to suspend your access to the PLAI™ platform, temporarily or permanently, without notice if deemed necessary for maintenance, security, or other operational reasons.

5.4 Effect of Termination: Upon termination, your right to access and use the PLAI™ platform will cease, and you may lose access to any data or content stored on the platform.

6. Limitation of Liability

6.1 To the maximum extent permitted by law, 4Learn and its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the PLAI™ platform, even if advised of the possibility of such damages.

6.2 By consenting to these terms of use you declare your understanding that the PLAI™ platform uses Large Language Model AI technologies and, whilst the 4Learn does everything they can to ensure truthfulness and accuracy of outputs, there may be factual inaccuracies or falsehoods produced by the system. You take full responsibility for the application of the outputs from the PLAI™ platform and acknowledge the need to adopt Responsible AI practices by having a ‘Human in the Loop’. 4Learn accepts no liability, substantive or consequential, to the outputs of its systems.

7. Governing Law and Jurisdiction

7.1 This Agreement shall be governed by and construed in accordance with the laws of Singapore. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Singapore.

8. Modifications and Updates
8.1 4Learn reserves the right to modify, update, or discontinue the PLAI™ platform or this Agreement at any time without notice. It is your responsibility to review this Agreement periodically to stay informed of any changes.

By using the PLAI™ platform, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree to these terms, you must immediately cease using the PLAI™ platform.
